Things to Know After Getting Injured in a Car Accident
Toronto Car Accident Law
What’s the first thing I should do after getting hurt in a car accident? Can I apply for Accident Benefits even if the accident was my fault?
Receive the medical attention you require. After seeing the emergency room doctor and/or your own family doctor, they will recommend you receive rehabilitative treatment. These services are not covered by OHIP. Therefore your insurance company will have to cover these expenses.
The very first step, therefore, should be to apply for Accident Benefits from your insurance company. This application must be made within 7 days of your accident.
You can apply for these benefits and are entitled to them even if the accident was your fault.
We do not receive any money until your case ends in a settlement with the insurance company or after a trial. You do not pay any legal fees out of your own pocket. We receive a fixed percentage of the settlement money you get from the insurance company. We normally charge the industry standard percentage of 30%. What kind of benefits can I receive from the insurance company after getting hurt in a car accident?
Depending on the circumstances and extent of your injuries, you may be entitled to receive benefits in the following areas:
- Income replacement benefits
- Non-earner benefits
- Medical and Rehabilitative treatment benefits.
This depends on the nature and extent of your injuries. This is often a subject of intense debate between your insurance company and you (and your lawyer). The debate usually centres on whether your injuries fall under the “Minor Injury Guideline” or not.
If your injuries are considered “minor”, then you are entitled for up to $3,500 for treatments, which will usually cover about 2-3 months worth of treatments.
If your injuries are more serious, then you may be entitled to more. You need to fight to receive the support that you are entitled to due to your injuries.
There are circumstances in which you can sue the other driver for the accident. This is called a “tort” claim. Normally several criteria must be met in order to successfully sue another driver for a car accident:
- The accident must not have been your fault
- The accident must have resulted in serious injuries
- Your injuries must be worth at least $30,000
A determination of these criteria depends on the specific facts of the case. Needless to say, what amounts to a $30,000 value has been fought over intensely in the courts.
